Abstract

Apresenta-se neste trabalho um breve histórico da evolução da legislação brasileira envolvendo as cavidades naturais subterrâneas (cavernas), uma análise comparativa com outras legislações sobre o tema no mundo e uma análise detalhada das dificuldades trazidas pela Instrução Normativa 2/2009 do Ministério do Meio Ambiente, que complementa o Decreto 6.640/2008, para o licenciamento ambiental de empreendimentos de mineração de ferro. A análise do Decreto 6.640/2008 e da IN 2/2009 aborda questões tais como: seus princípios, conceitos técnico-científicos e suas aplicabilidades, além de uma avaliação dos seus impactos sobre o planejamento mineiro. Os resultados obtidos com essa análise mostraram equívocos conceituais, indefinição de procedimentos e critérios para a análise de relevância das cavidades, comprometendo a viabilidade técnica, jurídica e operacional do licenciamento ambiental dos empreendimentos e efeitos negativos sobre o melhor projeto para a lavra.

 

This paper presents the main aspects of caves protection legislation in Brazil and a comparison among this legislation and others around the world. The analysis of Brazilian legislation involved a discussion about its principles, technical and scientific concepts, applicability and its impact on mining project. The results showed conceptual errors, uncertainty of procedures and criteria for determining the relevance of caves, compromising the technical, legal and operational environmental licensing of projects, with negative effects on the optimal design for mining.
